3D Ball Smack — Terms of Service

1. Agreement

These terms are an agreement between you and Ponotech LLC, a limited liability company established in Hawaii, United States ("we", "us"). By creating an account or playing 3D Ball Smack you accept them. If you do not accept them, do not use the game.

How we handle your personal information is described separately in our Privacy Policy.

2. Eligibility

3D Ball Smack includes chat with other players. You must be at least 16 if you are in the European Economic Area or the United Kingdom, and at least 13 everywhere else. If you are under the age of majority where you live, you may only use the game with a parent or guardian's involvement.

3. Your account

You are responsible for your account and for keeping your password secure. Do not share your account or impersonate anyone else. Tell us at ballsmack@ponotechhi.com if you think someone has accessed it without your permission.

You can delete your account at any time from Settings → Delete Account. Deletion is permanent.

4. Content and conduct — zero tolerance

3D Ball Smack lets you send chat messages and choose a display name and avatar. You are solely responsible for what you submit. You must not submit or do any of the following:

• Harassment, bullying, threats, or targeting another player
• Hate speech or slurs, or content attacking people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age
• Sexually explicit content, and under no circumstances any sexual content involving minors
• Content promoting violence, self-harm, terrorism, or illegal activity
• Spam, advertising, scams, or phishing
• Impersonating another person, or posting someone else's personal information
• Cheating, exploiting bugs, automating play, or interfering with other players' matches
• Attempting to access accounts, data, or systems you are not authorised to access

How we enforce this. The game filters known objectionable language from chat and display names before anyone sees it, and that filtering cannot be switched off. You can block any player, and you can report a player or a message from inside the game. We review reports and aim to act within 24 hours, removing content and suspending or permanently banning accounts as warranted. Reports can also be sent to ballsmack@ponotechhi.com.

By submitting content you grant us a non-exclusive, worldwide, royalty-free licence to host, display and transmit it for the purpose of operating the game. You keep ownership of your content.

5. Purchases

3D Ball Smack may offer cosmetic items for purchase. Buying one grants you a limited, personal, non-transferable licence to use it inside 3D Ball Smack. Cosmetic items are not property, have no cash value, cannot be traded, and cannot be exchanged for money. They affect appearance only and give no gameplay advantage.

Purchases are processed by Apple or Google under their own terms, and refunds are handled by them under their policies. We never receive your payment details.

If you are a consumer in the UK or EEA, you normally have 14 days to withdraw from a purchase of digital content. By buying an item and using it immediately, you ask us to begin supply during that period and acknowledge that you lose the right to withdraw once supply has begun. This does not affect your other statutory rights.

We may retire or alter items, including for balance or legal reasons. If we withdraw an item you have paid for and you lose access to it entirely, contact us and we will put it right.

6. Availability

3D Ball Smack is an online, server-based game. We do not guarantee uninterrupted availability, and we may change, suspend, or discontinue any part of it, including matches in progress. In rare cases we may need to reset game data.

7. Suspension and termination

We may suspend or terminate your account if you breach these terms, if required by law, or to protect other players. Serious breaches — in particular the content and conduct rules in section 4 — may result in immediate permanent removal.

Where we suspend or ban an account we will tell you why. You can appeal to ballsmack@ponotechhi.com, and a person will review it.

8. Disclaimers and liability

3D Ball Smack is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost data or lost profits. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Nothing in these terms limits liability that cannot lawfully be limited — including death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. If you are a consumer, you keep all mandatory rights under the consumer law of your country of residence, and nothing here overrides them.

9. Governing law

These terms are governed by the laws of the State of Hawaii, United States, without regard to its conflict-of-laws rules, and the courts of Hawaii have jurisdiction over disputes.

If you are a consumer in the UK or EEA, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts.

10. Apple and Google

If you obtained 3D Ball Smack from the Apple App Store or Google Play, you acknowledge that these terms are between you and us, not Apple or Google; that Apple and Google have no obligation to provide support for the app; and that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes

We may update these terms. If a change is material we will show a notice in the game before it takes effect. Continuing to play afterwards means you accept the updated terms.
